1. Information We DO NOT Collect

To maximize your privacy, we explicitly promise that, without your authorization, we will never upload, access, or process the following types of core data generated or handled on your local device:

  • Your Chat History: All conversations and interactions you have with PetClaw AI.
  • Your Local File Content: The content of any local files you authorize PetClaw AI to access, create, or modify.
  • Your Clipboard Data: Information on your clipboard that PetClaw AI may access to perform a task.
  • Screen Content or Recordings: Screen information observed by the AI agent while performing tasks.
  • Detailed Usage Patterns: Behavioral patterns concerning how you use your computer or interact with specific applications.

In short, your core work and interaction data remain on your local device. We cannot and do not want to access it. Consequently, we will never use this data for any commercial purpose, especially not for training any artificial intelligence models.

2. The Limited Information We Collect and Why

To provide, maintain, and improve the Service, we collect only the limited types of information that are strictly necessary for essential functions:

  • Account Information: Your email address, used to create and manage your account and send service-related communications.
  • Payment & Subscription Information: Billing details processed through third-party payment processors (e.g., Stripe). We do not store your full credit card number or financial details.
  • Anonymized Usage Statistics: Non-personally identifiable data such as crash reports and feature usage frequency, used to improve the Service.
  • Device Technical Information: Basic technical data (e.g., OS version, app version) required to ensure compatibility and stability.
  • User Feedback: Any information you voluntarily provide when contacting our support team.

3. Legal Basis for Processing (EEA & UK Users)

For users from the European Economic Area (EEA) and the United Kingdom, our legal bases for processing your personal information are as follows:

  • Performance of a Contract: We process your account and payment information to fulfill our agreement with you and provide the subscription service you have purchased.
  • Legitimate Interests: We process anonymized usage statistics and device technical information based on our legitimate interests in maintaining and improving our services.
  • Your Consent: When you voluntarily submit feedback, we process that information on the basis of your consent.

4. Information Sharing and Disclosure

We do not sell your personal information to third parties.

We only share your information in the following limited and necessary circumstances:

  • Payment Processors: We share payment information with third-party services like Stripe to process your subscription payments.
  • Cloud Service Providers: We use infrastructure providers such as AWS or Google Cloud to host our backend services and databases.
  • LLM Providers: The Service works by sending and receiving data to third-party LLM providers like OpenAI. We act as an intermediary for these API calls.
  • Legal Requirements: We may disclose your information if required to comply with a legal obligation or to protect rights, property, or safety.
  • Business Transfers: If the Company is involved in a merger, acquisition, or sale of assets, your limited information may be transferred. We will notify you via email or a prominent notice on our website.
  • With Your Consent: We may share information with third parties when we have your explicit consent to do so.

5. Data Security

We implement industry-standard technical and organizational measures to protect the limited information we collect from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. These measures include data encryption, access controls, and secure software development practices. However, no internet transmission or electronic storage method is 100% secure, so we cannot guarantee its absolute security.

The security of your local data is primarily your responsibility. Since your core interaction data is stored on your local device, we strongly recommend that you maintain up-to-date operating system and software security patches and perform regular data backups.

6. Data Retention

  • Account Information: Retained for as long as your account is active. Deleted within a reasonable timeframe upon account deletion, unless required by law.
  • Payment and Subscription Information: May be retained for longer periods as required by financial and tax regulations.
  • Anonymized Usage Statistics: As this data is anonymous, we may retain it indefinitely for long-term trend and product analysis.

7. Your Data Protection Rights

Depending on your jurisdiction (particularly if you are a resident of California, the EEA, the UK, or Switzerland), you may have the following rights:

  • Right of Access: Request access to the personal information we hold about you.
  • Right to Rectification: Request correction of inaccurate personal information.
  • Right to Erasure: Request the deletion of your personal information ("Right to be Forgotten").
  • Right to Restrict Processing: Request the restriction of processing of your personal information.
  • Right to Data Portability: Receive your personal information in a structured, commonly used, and machine-readable format.
  • Right to Object: Object to our processing of your personal information based on our legitimate interests.
  • Right to Opt-Out (CCPA): Opt-out of the sale or sharing of your personal information (we reiterate that we do not engage in such activities).

To exercise these rights, please contact us using the details in Section 10. We will respond in accordance with applicable law and may ask for additional information to verify your identity.

8. Children’s Privacy

The Service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we may have collected such information, please contact us immediately so we can take appropriate action to delete it.

9. International Data Transfers

We operate globally, and the limited information we collect may be transferred to, stored in, and processed in jurisdictions outside of your home country, including the United States. For users from the EEA, UK, and Switzerland, we rely on mechanisms such as the European Commission-approved Standard Contractual Clauses to provide adequate safeguards for cross-border transfers.
